General Terms and Conditions Online Ticket Shop

1. 1    The business relationship between Zoo Salzburg Gemeinnützige GmbH, FN 235890 y, Hellbrunner Straße 60, 5081 Anif (hereinafter also referred to as the ‘Seller’) and the customer (hereinafter referred to as the ‘Customer’) is governed by the following General Terms and Conditions of the Online Ticket Shop, which are valid at the time of the order, for all orders placed in the Seller's online ticket shop on the website https://zoosalzburg.axess.shop/de/Products/Tickets/
1.2    The Seller's customer service can be contacted for questions, complaints and objections by telephone on +43 662 8201760 and by email at office@salzburg-zoo.at
1.3    The General Terms and Conditions may be amended by the seller at any time. 
1.4    Any deviating, conflicting and/or supplementary terms and conditions of the customer shall not apply unless the seller has expressly agreed to them in writing prior to accepting the order.
1.5    By placing an order, the customer agrees to these General Terms and Conditions, which can be accessed and printed from the website https://salzburg-zoo.at/en/terms-and-conditions.

2.1    The customer can select products from the seller's range without obligation by clicking on the [Book now] button and collect them in a so-called shopping basket by clicking on the [Continue] button. 
The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order. Service descriptions in catalogues and on the seller's websites do not constitute a warranty or guarantee.
2.2    The customer can then proceed to the checkout by clicking on the [Checkout] button in the shopping basket and, after entering their email address and confirming their agreement to the Online Ticket Shop's General Terms and Conditions valid at the time of ordering by ticking the checkbox, clicking on the [Proceed to payment] button to complete the ordering process. By clicking on the [Buy] button, the customer submits a binding offer to purchase the products in the shopping basket.
2.3    If the customer purchases a voucher, they must actively confirm by ticking the checkbox that they are aware that they lose their right of withdrawal under the FAGG (Austrian Distance Selling Act) when redeeming the vuchers during the withdrawal period.
2.4    At the seller's discretion, the seller may then make the payment receipt and the purchased product available for download to the customer. Once this has been done, the purchase contract is concluded without prior express declaration of acceptance. In addition, the corresponding payment receipt and the purchased product will also be sent to the email address provided. Furthermore, the seller is entitled to reject an order at any time without giving reasons. 
2.5    If, at the time of the customer's order, the products selected by the customer are not available, even partially, the seller shall notify the customer of this within 3 days. If the product is permanently unavailable and the seller does not issue an explicit declaration of acceptance, no contract shall be concluded.

3.1    All prices stated on the seller's website are in EUR and include the applicable statutory value added tax.
3.2    Payment options are limited to credit and debit cards. 
3.3    The customer must observe the general terms and conditions of Saferpay, the third-party provider responsible for payment processing.

4.1    The customer can choose between the following five products: 
4.1.1    Day ticket 
Individual day tickets can be purchased for adults, young people (aged 15 to 19), children (aged 4 to 14) and dogs for a date selected by the customer and are only valid for the selected day.
4.1.2    Family ticket 
Family tickets can be purchased for a date selected by the customer and are valid for two adults and one child (aged 4 to 14). When purchasing a family ticket, individual tickets for additional children (aged 4 to 14) can be added for the same date at a reduced price.
4.1. 3    Day ticket voucher 
Vouchers for day tickets for adults, teenagers (aged 15 to 19), children (aged 4 to 14) and dogs can be purchased. This voucher is already a valid ticket and can be redeemed at the entrance to the Salzburg Hellbrunn Zoo ticket office during regular opening hours within one year of the date of purchase.
4.1.4    Family ticket voucher 
Vouchers for family tickets are valid for two adults and one child (aged 4 to 14). The voucher for a family ticket can be extended to include vouchers for individual tickets for additional children (aged 4 to 14) at a reduced price. This voucher is already a valid ticket and can be redeemed within one year of the date of purchase at the ticket office of Salzburg Hellbrunn Zoo during regular opening hours.
4.1.5    Annual ticket voucher 
Vouchers for an annual ticket can be purchased for adults, young people (aged 15 to 19), children (aged 4 to 14) and dogs. This voucher is not a valid ticket, but can be redeemed for a personal annual pass in credit card format at the ticket office of Salzburg Hellbrunn Zoo within one year, but no earlier than 15 days after the date of purchase. The personal annual pass is valid for one year from the date of issue. An additional fee of EUR 3 is charged at the ticket office for issuing the annual pass in credit card format, unless the customer already has a credit card.  
4.2    If one of the products listed under points 4.1.1. and 4.1.2. (so-called tickets) is not used on the selected and contractually agreed date for a reason within the customer's sphere of influence, the customer shall have no claim whatsoever for reimbursement from the seller. 
4.3    If one of the products listed under points 4.1.3. – 4.1.5. (so-called vouchers) is not redeemed by the customer within the above-mentioned period, it can still be redeemed within a further grace period of 3 years. In this case, however, if there has been an interim price increase or an increase in the respective product price, an additional payment must be made in the amount of the difference between the original purchase price and the current price.
4.4    Products delivered in electronic form contain a QR code, which must be presented either in printed form or on a smartphone upon entry to Salzburg Hellbrunn Zoo. 
4.5    Please note that all other tickets (senior citizens, groups, etc.) and discounted day tickets (guest cards, savings vouchers, etc.) are only available at the ticket offices on site and cannot be purchased in the online ticket shop.

5.1    The warranty is determined in accordance with the statutory provisions.
5.2    All claims for damages are excluded in cases of slight negligence. This does not apply in the event of a breach of cardinal contractual obligations and for personal injury or – in the case of consumer transactions – for damage to items accepted for processing. The existence of slight or gross negligence or intent must be proven by the injured party, unless it is a consumer transaction. The provisions on damages contained in these General Terms and Conditions or otherwise agreed upon shall also apply if the claim for damages is asserted in addition to or instead of a warranty claim.
5.3    Insofar as the seller's liability is excluded or limited, this also applies to the personal liability of the seller's employees, representatives and vicarious agents.

6.1    Right of withdrawal 
Consumers as customers have the right to withdraw from this contract within fourteen days without giving any reason. The period begins upon receipt of the tickets or vouchers. To exercise the right of withdrawal, the customer must inform the seller of their decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email). The customer may use the attached model withdrawal form for this purpose, but this is not mandatory. To meet the withdrawal deadline, it is sufficient for the customer to send the notification of exercising the right of withdrawal before the withdrawal period expires.
6.2 Consequences of revocation
If the customer revokes this contract, the seller must reimburse all payments received from the customer immediately and at the latest within fourteen days from the day on which the seller received notification of the revocation of this contract. The same means of payment used by the customer in the original transaction shall be used for this repayment, unless expressly agreed otherwise with the customer; in no event shall the customer be charged for this repayment.
6.3    Sample cancellation form

6.4    Exceptions to the right of withdrawal
In accordance with § 18 (1) (10) FAGG, there is no right of withdrawal for contracts for the purchase of tickets for which a date has already been selected by the consumer at the time of conclusion of the contract.
In accordance with § 18 (1) (1) FAGG, there is also no right of withdrawal for contracts for the purchase of vouchers if these have already been redeemed as individual day or family tickets at the time of withdrawal. By purchasing these vouchers, the customer declares that they are aware that they lose their right of withdrawal with regard to this contract upon redemption of the vouchers. 

7.1    The customer is obliged to notify the seller immediately of any changes to their email address as long as the contractual transaction has not been completely fulfilled by both parties. If the customer fails to do so, declarations shall be deemed to have been received even if they are sent to the last known email address.
7.2    Samples, catalogues, brochures, illustrations and the like shall always remain the intellectual property of the seller; the customer shall not receive any rights of use or exploitation whatsoever.

8.1    The place of performance is the registered office of the seller. 
8.2    The contract language is German. 
8.3    The contracting parties agree to Austrian domestic jurisdiction. If the transaction is not a consumer transaction, the court with jurisdiction at the registered office of the seller shall have exclusive local jurisdiction to decide all disputes arising from this contract.
8.4    This contract is governed by Austrian substantive law, excluding the referral provisions of international private law (e.g. EVÜ, ROM I-VO) and the UN Convention on Contracts for the International Sale of Goods. With regard to a consumer, this choice of law shall only apply insofar as it does not restrict any mandatory legal provisions of the country in which the consumer has his domicile or habitual residence.
8.5    Should any provisions of this contract be or become legally ineffective, invalid and/or void during its term, this shall not affect the legal effectiveness and validity of the remaining provisions. In this case, the contracting parties undertake to replace the legally ineffective, invalid and/or void (legally ineffective, invalid and/or void) provision with one that is legally effective and valid and corresponds to the economic effect of the replaced provision as far as possible and legally permissible.

9.1    The seller processes the customer's personal data for specific purposes and in accordance with the statutory provisions.
9.2    The personal data provided for the purpose of ordering products (such as name, email address, postal address, payment details) will be used by the seller to fulfil and process the contract. This data is treated confidentially and is not passed on to third parties who are not involved in the ordering, delivery and payment process.
9.3    The customer has the right to request information free of charge about the personal data stored about them by the seller. In addition, they have the right to have incorrect data corrected, blocked and deleted, provided that there is no legal obligation to retain it.
